TAXATION/ESTATE PLANNING

Middleton Reutlinger’s varied tax practice covers all facets of federal and state income taxation for corporations, partnerships, individuals, exempt organizations, trusts and estates. The firm is experienced in counseling clients with regard to tax effects in the formation, operation and winding-up of business enterprises, mergers, acquisitions and reorganizations and real estate transactions.

In one of the significant tax cases in Kentucky, the firm pursued a tax refund for Kentucky residents with respect to an unconstitutional tax on intangible property for several years. This persistence resulted in a tax refund to Kentucky residents of more than $180 million. St. Ledger v. Com., Revenue Cabinet, (1997).

The firm’s tax practice includes tax planning and civil. The firm also represents clients before the Internal Revenue Service with respect to federal income, estate, gift and employment tax matters and before state and local government authorities with respect to income, sales, real estate and other transactional taxes.

ESTATE PLANNING AND ADMINISTRATION

Middleton Reutlinger represents real estate developers, small business owners, corporate executives, physicians and other individuals in estate planning and estate administration matters. This includes overall planning of wealth management during a client’s lifetime, extending through the administration of estates and trusts.

The firm prepares wills, living trusts, irrevocable insurance trusts, marital deduction trusts, prenuptial agreements, living wills and powers of attorney.

Estate planning also focuses on asset ownership, including insurance ownership and beneficiaries, the handling and disposition of pension and profit-sharing interests at retirement and death and methods to reduce death tax obligations. The firm also advises clients on making gifts, protecting business property before entering into a marriage and planning for succession in a closely held business.

Recognizing the difficulties inherent in succession of a family owned business, the firm is experienced in advising the family how to ensure such succession, taking into account the financial and emotional well being of all involved.
