Mr. Duvall was recognized by Kentucky Super Lawyers® in intellectual property for 2007, 2008, and 2009. He has served as local counsel for various cases in Kentucky federal courts. Notably, Mr. Duvall served as co-counsel representing the Petitioner in the landmark U.S. Supreme Court trademark case Moseley v. V Secret Catalogue, Inc. in which the Court issued a unanimous 9-0 decision in favor of the Petitioner.
Mr. Duvall is active in efforts toward the ongoing development of trademark law. He has served many years in leadership of the International Trademark Association (INTA), and now serves on its U.S. Amicus Subcommittee, participating in the filing of “friend of the court” briefs in significant cases. One recent brief which he co-authored was filed in a case pending before the U.S. Court of Appeals for the Ninth Circuit, Levi Strauss & Co. v. Abercrombie & Fitch Trading Co., No. 09-16322. He served on an INTA Task Force relating to the Well-Known Marks Doctrine and appeared at a symposium on the topic at the University of Dayton School of Law on “Superstar Marks” with Professor Graeme Dinwoodie.
His role as a principal drafter of the Trademark Dilution Revision Act provided a unique perspective for the article Chasing Moseley’s Ghost: Dilution Surveys Under the Trademark Dilution Revision Act, which he co-authored, in the Nov.-Dec. 2008 issue of The Trademark Reporter®. Previously his article The Trademark Dilution Revision Act of 2006: Balanced Protection for Famous Brands in the Nov.-Dec. 2007 issue was noted as “Recommended Reading” in John Welch’s The TTABlog®.
Mr. Duvall serves as an Adjunct Professor of Law at the University of Louisville Brandeis School of Law, having taught Intellectual Property Licensing and Transfer, Trademark Law (Basic and Advanced), and Advanced Trademark Practice. He has lectured widely and has published numerous articles on trademark and copyright law, the Internet and first amendment issues.
