Mark S. Fenzel is an experienced litigator focusing in insurance defense, professional errors and omissions, school law and commercial litigation. He is a frequent presenter of school law and tort seminars and papers, and has lectured extensively in these areas. He has argued before a number of appellate courts, and has been involved in many significant court decisions. These include Cornett v. Jefferson County Board of Education , which confirmed a school board’s right to conduct drug testing of school bus drivers; Beckham v. Jefferson County Board of Education , involved Kentucky’s Open Records Act, and Kirschner v. Louisville Gas & Electric Company a landmark negligence case in Kentucky.

Mr. Fenzel represents numerous insurance companies and self insured corporations. These involve employment claims, personal injury claims, and professional errors and omissions against attorneys, accountants and other professionals. His undergraduate degree in accounting assists him in defending these cases, which often involve complex financial issues. Mark also represents a number of Louisville businesses, and helps them with a variety of legal needs.

Prior to joining Middleton Reutlinger, Mr. Fenzel served as an attorney with the Judge Advocate Generals Corp of the United States Navy. His experience included two years as a trial attorney at Subic Bay Naval Base in the Republic of the Philippines. There, he handled many complex criminal courts martials, and tried cases in interesting venues such as on board the U.S.S. Constellation, and a number of other Navy ships in the Indian Ocean. In San Diego, California, Mr. Fenzel was named as a Special Assistant U.S. Attorney. He was the first Special Assistant to consolidate the Navy’s prosecution of federal crimes in San Diego County. His military awards include the Navy Achievement Medal, the Navy Expeditionary Ribbon, and the Meritorious Unit Citation.
