Education Law

For more than a decade, Middleton Reutlinger has represented a number of school boards, school leaders, and insurance companies in the defense of Kentucky educators. The school board claims and matters that we handle include personnel issues, personal injuries, special education cases and complex constitutional claims. We are also involved in school finance, taxation and reorganization issues, and routinely advise several districts on day-to-day business matters. We have defended school boards in state and federal courts and before a number of administrative agencies. We have done similar work for Kentucky universities and colleges.

Middleton Reutlinger has been involved in a number of important state and federal decisions dealing with school law issues. Many of these have resulted in important, precedent setting opinions. These include Beckham v. Jefferson County Board of Education, Ky. (1974), which dealt with novel issues arising under Kentucky’s Open Records Act, and Cornette v. Jefferson County Board of Education, Ky. (1995), where the Kentucky Court of Appeals affirmed a school board’s ability to conduct drug testing for school bus drivers and Blau v. Ft. Thomas Board of Education (2005), a case involving a school dress code. Other cases have involved teacher pay and tenure, religious freedom, insurance issues, and special education.
