MR Attorney Co-Authors Amicus Curiae Brief in Ninth Circuit Trademark Dilution Case

Scot A. DuvallMiddleton Reutlinger IP attorney Scot A. Duvall co-authored an amicus curiae (”friend of the court”) brief on behalf of the International Trademark Association (INTA), in a case pending before the U.S. Court of Appeals for the Ninth Circuit, Levi Strauss & Co. v. Abercrombie & Fitch Trading Co., No. 09-16322. The INTA brief urges the Ninth Circuit to reject an “identical or nearly identical” marks requirement for claims of dilution by blurring under the Trademark Dilution Revision Act (TDRA), available only to the owners of famous and distinctive trademarks. The INTA brief explains that the degree of similarity of the marks is a factor to be considered with other relevant factors, and that no threshold requiring a particular degree of similarity was established by the TDRA.

Mr. Duvall was a principal drafter of the Trademark Dilution Revision Act. Prior to that, Mr. Duvall served as co-counsel representing the Petitioner in the landmark U.S. Supreme Court trademark case, Moseley v. V Secret Catalogue, Inc., in which the Court issued a unanimous 9-0 decision in favor of the Petitioner.
